Dr. Jaishankar on Deportation of Illegal Indian Migrants from the USA – A Report

Demolishing the recent hue and cry regarding deportation of illegal Indian migrants from the USA, External Affairs Minister, Dr. S. Jaishankar presented his statement in both Lok Sabha and Rajya Sabha on 6th February, 2025.

In his statement Dr. Jaishankar pointed out the importance of people-to-people connection between India and the USA. At the same time, he also mentioned the significance of legal mobility and migration. He also briefly described how illegal migration could associate themselves with other illegal activities. Helpless, forced to work under inhumane condition, easy prey to various crimes – illegal migration is not good for those trapped illegal migrants too.

It is the obligation of all nations to take back their nationals, if they are found to be living illegally abroad – a general accepted principle in international relations.

In this connection, Dr. Jaishankar mentioned that deportation from the USA is not a new process. He also presented data, which showed continuous process of deportation from 2009. The data, which was taken from the Bureau of Immigration, MHA, India, showed that from 2009 to till 5th February 2025 around 15, 668 people deported from the USA to India.

The Minister also ensures that the procedure of restraining has remained in practice from 2012. The Minister also informed that women and children are not restrained. The process also takes care of the needs of deportees during transit related to food or other necessities, for example, possible medical emergencies, are attended to. During toilet breaks, deportees are temporarily unrestrained if needed in that regard. This is applicable to both chartered civilian aircraft and the military aircraft. He also ensured the 5th February 2025 flight which carried deportees only followed the same procedures.

The Minister also informed both the Houses that the government of India is engaging the US Government to ensure that the returning deportees are not mistreated in any manner during the flight. He also pointed out that the main focus Indian government is to crackdown illegal migration industry and taking steps to ease visas for the legitimate traveler. He also ensured both the Houses that on the basis of information provided by returning deportees about the agents and others involved, law enforcement agencies will take necessary preventive actions.
